Question: I recently received a set of cookbooks that I never ordered! Do I have to pay for them or return them?
Answer: Virginia Law states that if you received, from a person or business, merchandise that has not been ordered or requested by you, you may consider the merchandise an unconditional gift. The law' pertaining to “Unsolicited Goods” futher states that if you received unsolicited merchandise, you have no obligation to return what was sent or to pay for it. The merchandise may be disposed of in any manner you choose.
It is not uncommon for a company to send a customer unordered merchandise and then proceed to demand payment. If this happens to you, you should send a letter to the company stating your intention to keep the shipment as a free gift.
