Sallie Curtis Clement, Devisee under the Will o( William Vincent Robinson, Deceased, will offer at public auction the following described tracts or parcels of land, constituting the William Vincent Robinson farm, known as Gooney Manor, situate In South River Magisterial District, Warren County. Virginia, near Browntown. Said tracts or parcels will be offered for sale both as separate tracts and In the aggregate. Said parcels or tracts of land are more particularly described as follows:
TRACT I: All that certain parcel of land, together with all improvements thereon and all rights, rights of way and appurtenances thereunto belonging, lying and being situate on the Southeastern side of Route 631. containing 371.89 acres, more or less (THIS BEING A SALE IN GROSS AND NOT BY THE ACRE). Said parcel also has road frontage on Route 613 and Route 649, and is crossed by Gooney Run and Greasy Run, with wooded and open lands.
TRACT II: All that certain parcel of land, together with all Improvements thereon and all rights, rights of way and appurtenances thereunto belonging, fronting on the Northwestern side of Route 631, containing 471.75 acres more or less (THIS BEING A SALE IN GROSS AND NOT BY THE ACRE). Said parcel also has road frontage on Route 6?2 and Route 613, with wooded and open lands.
The foregoing tracts of land being the same property known as Gooney Manor, which was devised u.ider me terms of the Last Will and Testament of William Vincent Robinson. Deceased, to Sallie Curtis Clement (being one and the same as Sally Curtis Clement), which Will Is of record In the Clerk's Office of the Circuit Court of Warren County, Virginia, in Will Book 29. at Page 756

This property is sold subject to the conditions, rights of way, restrictions easements and reservations contained In the deeds forming the chain of title to this property. Real estate taxes for 1993 will be prorated as of closing.
TERMS OF SALE: All cash. Purchaser shall pay for all recording charges, including State Grantor Tax, Revenue Tax, settlement fees and all costs of conveyancing, which will be by Special Warranty Deed. A deposit of $10,000.00 for each parcel of land offered by certified check or approved check will be required of successful bidder at the time of sale, or If said lands are sold In the aggregate, a deposit of $20,000.00 shall be required of the successful bidder by certified check or approved check for all of said lands Settlement In full shall be made within thirty (30) days from the date of sale at the offices of F & M Bank - Winchester, Trust Department. 115 North Cameron Street, Winchester, Virginia, 22601. Time Is of the essence as to matters of closing. At settlement, the balance of the purchase price, over and above the retained deposit, will be due In cash or equivalent Immediately available fundsotherwise, the Owner reserves the right to forfeit the deposit and apply the same first to the expenses of sale, and readvertise and sell the property at the risk and cost of the defaulting purchaser; or without forfeiting the deposit the Owner may avail herself of any legal or equitable rights against the defaulting purchaser. "
The Owner, In her sole and absolute discretion, RESERVES THE RIGHT(i) to waive the deposit requirement; (ii) to extend the period of time within which the purchaser is to make full settlement; (iil) to withdraw the property from sale at any time prior to the termination of the bidding; (Iv) to keep the bidding open for any length of time; (v) to reject all bids; and (vi) to postpone or set over the date of sale. In the event the Owner deems it best for any reason at the time of sale to postpone or continue this sale from time to time such notices of postponement or setting over will be In a manner deemed reasonable by the Owner. Additional terms and conditions may be announced on date of sale, which shall become a part of the terms of said sale.
The subject property will be sold in "as Is’ condition, without any warranty of any kind.
