Fast Track Regulation to Designate a Portion of the
Hazel River as Exceptional State Waters
NOTICE OF ACTION: The State Water Control Board is considering the amendment of a regulation on water quality.' PuRPOSE OF NOTICE To inform the locality particularly affected by the proposed regulation that the Board authorized the Department to promulgate for public comment using the fast-track process established in § 2.2-4012.1 of the Administrative Process Act for regulations expected to be non-controversial. The Board s authonzation should also be understood to constitute its adoption of the regulation at the end of the public comment penod provided that (i) no obiection to use of the.fast-track process is received from 10 or more persons, or any memoer of the applicable standing committee of either house of the General Assembly or of the Joint Commission on Administrative Rules, and (ii) the Department does not hnd T necessary, based on public comments or for any other reason, to make any changes to the proposal. In addition to any other comments, the Board is seeking comments on the costs and benefits of the proposal and on any impacts of the regulation on farm and forest land preservation. The proposed amendment is expected to be non-controversial. and therefore justifies using the fast track process. The segment of Hazel River intended for Exceptional State Waters designation is entirely on public lands (Shenandoah National Park) and impacts are not expected for individual ripanan landowners or businesses. Water Quality Standards DESCRIPTION OF PROPOSED REGULATION: The proposed amendment to the Antidegradation Policy section (9 VAC 25-260-30) of the State s Water Quality Standards regulation designates the Hazel River within Shenandoah National Park for special protection as an Exceptional State Water i9 VAC 25-260-30.A.3.C). LOCALITY PARTICULARLY AFFECTED: Rappahannock County HOW TO COMMENT: DEQ accepts written comments by e-mail, fax and postal mail. All written comments must include the full name and address of the person commenting and oe received by DEQ by 5 p.m. on the last day of the comment penod. DEQ prefers that comments, including a copy of supporting documents or exhibits, be submitted in writing. All testimony, exhibits and documents received are part of the public record.
