Gainer’s original sentence for the illegal dumping was 40 hours of community service. But things got worse for him when he forgot to appear for follow-up court dates on Sept. 18 and again on Oct. 16.
Gainer realized on Oct. 17 that he had missed another court date and turned himself into the Rappahannock County Jail, which is where he has been ever since.
On Tuesday in Rappahannock County General District Court, public defender Sonia Settle said Gainer missed his appointments because he was dealing with domestic issues that led him to “put his head in the sand” and ignore other obligations.
Judge Charles B. Foley sentenced Gainer to 50 days in jail for the original charge plus the two citations for contempt of court. Foley credited Gainer for the 49 days he has already served toward the 50-day sentence.
