IN EXECUTION of a certain deed of trust from Charles M. Fischbein, et. ux. to Douglas K. Baumgardner, Trustee dated and recorded April 22, 1983 among the land records in the Clerk’s Office of the Circuit Court of Rappahannock County, Virginia in Deed Book 144 at page 432, default having been made in the payment of the debt therein secured and being required to do so by the noteholders, the undersigned Trustee, after giving fourteen (14) days notice to the owner of the real estate of the date, time, place and terms of sale, will offer for sale the real estate with improvements thereon situated in Jackson Magisterial District, Rappahannock County, Virginia on
SATURDAY, MARCH 23,1985 at 11:00 a.m. at the front door
of the Courthouse in Washington, Virginia
Said real estate is the same and identical tract or parcel of land acquired by Charles M. Fischbein, et. ux. by deed of William Magee, et. al., dated and recorded April 22,1983 among the aforesaid land records in Deed Book 144 at page 430. Said real estate is described according to a plat and survey of V. H. & D., Inc., C. L. S., dated July 23,1979 and recorded among the aforesaid land records in Plat Book 3 at page 8 as "Lot Number 1.” Said parcel contains 5.5358 acres, more or less.
Sale shall be made subject to all existing easements, restrictions, covenants and other matters o,f record as the same may lawfully affect the real estate.
TERMS OF SALE: All cash. Settlement within thirty (30) days of the date of sale. A bidder s deposit of ten percent (10%) of the purchase price may be required.
