Dean comes, Mr. Luke added, seeking the sympathy of the court. However, “his financial problems are of his own doing.

“The court.” he said, “gave him the benefit of CDI. He has in effect thumbed his nose at CDI and at this court."

Mr. Fallon, in his argument for leniency for Dean, noted that “his problems are by his own doing but are beyond his ability to pay.”

Mr. Fallon added that Dean had pleaded guilty without the benefit of counsel, suggesting that the young man did not realize the gravity of the charges against him or of his responsibilities once he was assigned to the CDI program.

“He has just started working at a decent-paving job, and he can work out from under the fines over time,” Mr. Fallon suggested. “He cannot do that from a jail cell. Putting him in jail would only compound his problems severely.”
