The Board of Supervisors is asking Commonwealth’s Attorney Peter Luke to investigate an old land transaction for evidence of illegal circumvention of the county’s land use laws.
Attorney Frank Reynolds reported on Tuesday that he had been asked to research the subdivision of 10 small lots in the four to six-acre range which are located on Route 649 near Castleton.
According to Mr. Reynolds, the previous owner, Arley Estes, got the land through a partition suit in the late 1960s. Both judge and commissioners had determined that the 44-acre parcel couldn’t be subdivided into enough lots to satisfy the 12 or so parties involved, so when two private interests offered to buy the land as a 12-acre piece on one side of Route 649 and a 32-acre piece on the other, the court accepted the offer and issued a sale order, identifying the two parcels by a description of their outside boundaries, Mr. Reynolds told the supervisors. The order also mentioned a survey but that document was not attached to the deed, he added.
