somehow the 32 acres “showed up on the landbooks (in the Commissioner of Revenue’s office) as nine or ten lots,” Mr. Reynolds said.

Now the lots have been sold by separate deeds to William Springer; the deeds carry the notation that the metes and bounds of the lots are shown on the plat of the survey, according to Mr. Reynolds. ‘They’re very carefully not saying that the court partitioned the land into lots, but they’re inferring that.”

His clients are asking the county to determine if a de facto subdivision has been illegally accomplished in violation of the county’s zoning and subdivision laws or if the court actually decreed that the land be subdivided, the attorney explained. “Whether we can prove misdeeds or not, I don’t know.”
