Jimmy Swindler of Country Manor said he was “thrilled” by the court ruling. He said the company had been receiving correspondence from the state of Texas for two years asking that its sales tax be collected. “We ignored it, knowing that this case was in the courts,” he said.
He agreed that the mail order business would eventually have to collect sales taxes. He said he understood that retailers consider it unfair that they have to collect sales tax, while those in the catalog business escape it.
He said he also realizes states are feeling strapped for revenues, “but it would have been an unmanageable tax the way these states were trying to pursue it.”
Mr. Swindler said he hopes when the issue is finally resolved, the tax will be owed to the state where the order is filled. He said Virginia is in a good position because while its four and a half percent tax is higher than some, it is lower than most. He said Virginia has already attracted several large mail order businesses. “It would be a real boon to Virginia, if it can be done that way,” he said.
