After discussion, council approved the plat as submitted, after it was altered to delete any claim to land under Gay Street extended (a section of street not now in public use.)
Town council has been debating the consequences of her claim to the 900 square feet of Wheeler Street since the August meeting.
Town secretary Ray Gooch said Wednesday night, , “I thought it was a fairly simple issue at the outset. This raises my antennae.
“We asked them (Ms. Eagle and her attorney) to record a plat saying that they had no claim on Wheeler Street and they refused,” he added.
Looking up from the computer he uses to take notes, Gooch added in a quiet voice, “It angers me that they would put the council through this. It is just like the tree she cut down. She still hasn’t replaced it."
Talking about the plat itself, Town Attorney Frank Reynolds said, “it creates confusion in the court records.”
“In my mind it creates no rights whatsoever,” he added.
Town resident Charlie Eldred commented from the audience, “it is possible that the owners may claim contiguous land by attempting to merge the lots into one lot for zoning purposes.”
Reynolds then added, “the Commissioner of Revenue is going to pick up this (addition to the lot) and add it to the tax rolls, and our ordinance contains language that defines a ‘lot’ according to the tax rolls.”
(In fact that has already happened. On July 10, an addition was made to the tax records in the Commissioner’s Office increasing the lot size from 0.0259 acres to 0.0546 acres.) ‘
“My positiion is we should sue for a quiet title (to the street) if they a!*e unwilling to add language to the plat clearing claims to it.,” Morehouse said. ‘
After further discussion, the council asked Reynolds to try once again by letter to convince Ms. Eagle to agree to waive any claim to Wheeler Street, whith a clear understanding that if she refuses, the Town will sue to quiet its title to the street.
The vote was 6-1, as Miller refused to to go along with the others. “This is supposed to be a friendly town. We are rushing to a lawsuit,” he said.
