Last Thursday in Rappahannock County Circuit Court, Roger Baumgardner, 36, of Washington, was sentenced to 12 months in jail for petit larceny.
In June, Mr. Baumgardner pled guilty to petit larceny, a charge amended down from grand larceny, for stealing property belonging to Phillip Terrell of Castleton: He entered an “Alford plea” in which he denied guilt for the crime but agreed to plead guilty to an amended charge. Judge W. Shore Robertson suspended Mr. Baumgardner’s sentence but he will be on probation for two years and must pay restitution to Mr. Terrell in the amount of $1,375 and court costs. He told Mr. Baumgardner, “1 am taking a chance with you regarding your prior record.”
Mr. Baumgardner did admit that he stole a television from Mr. Terrell and pawned it for gas money. He felt he could get back the TV and return it before Mr. Terrell returned from a trip. Mr. Baumgardner said that he had had a drinking problem but that he has not had anything to drink for over three years. His employer and
