Before sentencing, Commonwealth’s Attorney Peter Luke pointed "out that Mr. Baumgardner had 17 prior charges on his record, and that suspending sentences in the past had not worked. He said, “The Commonwealth believes that a sentence of incarceration is warranted in this case.”
Public defender Roy Bradley argued that his client, Mr. Baumgardner, was willing to make restitution payments, and that his family and employers spoke highly of him. “It is abundantly clear that what we can expect out of this man is that he work and continue his sobriety. 1 urge the court that a further term of incarceration serves no useful purpose,” he said.
Also, an order was entered declaring Roger Baumgardner an habitual offender and he will lose his driver’s license for 10 years.
Beatrice Dawn Gordon, 35, of Sperrvville, who had been declared an habitual offender in 1989, had her driver’s license reinstated. She told Judge Robertson that she had not had a drink in over two years and had received counselling.
