James Combs, who owns property in the county had some questions for the Commission. He wanted to know what their definition of a lot is. Mr. McCarthy told him it is basically any piece of land in the Conservation Zoning District which will be cleared to build on, it could be any size.
He also wanted to know how they were going to measure the 50 foot restriction for building and they answered that it refers to elevation — the highest point on the moun; tain, or hill to the highest point on the house.
Mr. Combs said, “If you enact this you will make five of my properties un-build able. I have 50 acre lots and I have placed good covenants on them to protect the property. I think its (the recommended restrictions) illegal and I think you should reconsider it. I also think you will be challenged on it. I am against it if it takes away a property owner’s rights. If you make people’s lots un-build able what tax relief are you going to provide for them? I’m not against protecting the mountains but I think you’re going about it in the wrong way.”
