Proposed Amendments to the

Zoning Chapter of the

Rappahannock County Code The Board of Supervisors of Rappahannock County, Virginia, shall hold a public hearing on Monday, November 6, 2000, at 7:00 p.m. at the Courthouse in Washington, VA, to consider the following amendment(s) to the Rappahannock County Code provisions for Zoning (§170): 1. ) Amend §170-8 by adding a new definition, to read: FAMILY APARTMENT - For the purposes of this chapter, “family;’ shall be defined as being a member of the immediate family (i.e. a natural or legally defined offspring or parent of the owner. 2. ) Amend §170-36 B by adding a “SF' in the column for “HC” for "Schools, Public or Private, within a house or building with less than 25 students”; and an "SE” in the column for “CV" and “CG” for "Schools, Public or Private, within a house or building, greater than 25 students" 3. ) Amend §170-36 B by replacing “SF’ in columns for “CV”, “CG” & "HC" with a “P" 4. ) Amend § 170-36 E by adding a “F’ in the column for “HC’ for “Furniture Repair” 5. ) Amend §170-37 by replacing, under “Minimum Lot Size”, the line entitled “Family Transfer***^ancfreplacing with “Special Exception”; also, replace the dashed line under “the columns headed "RR-5”, & “R-2” with "2" and “1”, respectively. • 6. ) Amend § 170-40 A, (4) by inserting, at the end of the section: unless the parcel to be divided represents a single holding from the parcel of record of 1962 (i.e. there are no other owners of a portion of the parent tract) 7. ) Amend §170-63 C (2) by striking all of the language after the word "located” 8. ) Amend §170-63 C by adding a new standard: (4) School uses in commercial zoning districts shall have such setbacks as the BZA or Governing Body may stipulate as necessary to protect the public health and safety. 9. ) Amend §170-63 K (1) by deleting and renumbering the remainder of the section 10. ) Amend §170-66 E (4) by deleting the last sentence and replacing with: Offices may be open at other times only under such conditions as the BZA may stipulate. . 11. ) Delete current §170-105 and replace with: Notwithstanding any other provision of this Chapter, where any sign is permitted based on the content of the sign, then a sign containing "non-commercial” content shall be allowed upon the same terms, conditions, and restrictions as the permitted sign. This provision shall be interpreted so that in no case shall a sign containing "commercial” content be favored over one containing "non-commercial" content."Non-commercial” content means the sign content is not related solely to the economic interests of the speaker and the audience. These proposed amendments shall also be considered by the Rappahannock County Planning Commission at a Public Hearing to be held on Wednesday, ’ October 18, 2000, at 7:30 p.m. at the Rappahannock County High School Auditorium in Washington, VA.
