BOARD OF ZONING APPEALS

RAPPAHANNOCK COUNTY, VIRGINIA

PURSUANT to Section 170-129 of the Rappahannock County Code and Section 15.2-2204 of the 1950 Code of Virginia, as amended, notice is hereby given that the Board of Zoning Appeals for Rappahannock County, Virginia, will hold a public hearing on Wednesday, March 22, 2006 at seven-thirty in the evening in the Courthouse in Washington, Virginia, in order to consider the following applications:

SU 06-01-04 Erwin B. and Elizabeth A. Opitz, owners of 29.83 acres located at 374 Ben Venue Road, Flint Hill (Tax Map 22, Parcel 5, zoned A-Agricultural and C-Conservation, Wakefield District), desire a Special Use permit to construct a family apartment within an existing barn structure using existing septic, electric, and water. The outside appearance will not be modified except to add windows and doors. Use allowed under Section 170-36A of the Rappahannock County Code; Additional Standards under Section 170-62G of the Code.

SU 06-02-02 Patil Family Limited Partnership, owner of 51 acres at 39 Narmada Lane, Amissville (Tax Map 32. Parcel 14K, Jackson District, zoned A-Agricultural) desires a Special Use permit to allow present office space in an existing barn to be converted to an efficiency apartment for a vineyard manager and spouse. The space requires no physical alteration. Use allowed under Code Section 17036A of the Rappahannock County Code; Additional Standards under Section 170-62F of the Code.

No applicant or other party in interest, and no attorney for an applicant or party in interest, shall initiate a contact with a member of the BZA for the purpose of conducting a private discussion, in person or by telephone, concerning the merits of any application, appeal, or other matter pending before the BZA. No member of the BZA shall participate in any such private discussion. Site visits or similar contacts initiated by BZA members shall not constitute such ex parte contacts.

A COPY of the foregoing applications are on file at the Zoning Office in Washington. Virginia, and are available for public inspection, Monday through Friday, 8:30 AM to 4:30 PM. Said applications will be presented to the Rappahannock County Planning Commission at their regular meeting on Wednesday, March 15. 2006 at seven-thirty in the evening at the Rappahannock County Courthouse for such recommendation as the Commission may wish to make pursuant to Section 170-55. if any The above-named applicants, adjacent property owners, and any other parties desiring to be heard should be present at said meeting or should address their written comments to the Board of Zoning Appeals, c/o P.O.
