From a petition that they were illegally detained as slaves, the charges brought by the plaintiffs—Kitty and her three children—were amended to trespass and assault and battery for the trial.
The findings of the jury reflect the temper of the times: sympathy for the slave master who lost valuable property, not sympathy for the slave. On paper yellowed by age with lines written, reconsidered and then crossed out, the jury held that Kitty, Eliza and Mary were the property of Samual Maddox at the time of his death in 1837.
They found that before his death, Maddox duly made and published his Iasi will and testament, leaving his entire estate to his wife, Mary. The jury members pointed out, however, that she never qualified as executrix, a simple matter that required her to present herself at the clerk’s office answer a few questions relating to the heirs and post bond unless waived by the will.
