Returning to the issue of enforcement. Major Simmons reported that there is currently a bill before the General Assembly to give game wardens full police powers. This would enable wardens to enforce laws against shooting within 300 feet of a road, he said.
“What is the law as to posted land?” asked Bill Fannon. “Can anybody walk on your land with a gun?”
Baumgardner replied that the code requires land must be posted or that the landowner must give written or oral notice of prohibition against trespass.
"I abhor posting my land because i’m an avid hunter myself but I don’t know what else to do,” Fannon added.
Checking further in the code, Baumgardner reported that trespassing on unposted land without the consent of the owner qualified as a class three misdemeanor.
He also noted that the supervisors have the local option of passing an ordinance to prohibit hunting—not just discharging a firearm—in distances up to 300 feet from a public road.
