During the BZA hearings on Jenkins' application, the point was raised as to whether Article 14-6 of the Rappahannock zoning ordinance which provides that one single-family dwelling may be erected on any nonconforming lot waives sideyard, set-back and rearyard requirements.
"I have advised the board that the sideyard, set-back and rear-vard requirements of the ordinance apply to non-conforming as well as to non-non-conforming lots," Baumgardner wrote to the attorney general, and that Jenkins must therefore obtain a variance before building on the lot at issue.
