According to Konick, the planning commission recommended that Foster’s request be denied but the decision was reached when plans still called for the sixacre lot to be served by a 20foot right-of-way.
Supervisor Clarance Baldwin recalled from his experience that the Highway Department won’t accept a road into the state system until it serves three or more houses.
With a nine-acre balance left after Foster’s lot is sliced off, there’s no way there’s ever going to be more than two houses (served by the proposed road),” Konick pointed out.
By unanimous vote, the supervisors agreed to refer Foster’s request back to the planning commission with the change from the 20-to 50-foot right-of-way and notations on the plat showing the dates earlier land divisions were made from the quarry tract, the zoning on the property and its appraised value.
