He added that Hutton’s request was before the supervisors for exception approval because of three problems: (1) the size of the residue, (2) the question of whether the 2.9 acre lot was legally platted before 19b2 and thus eligible for the lam ily transfer provision and (d) the issue of whether it is allowable to give a famih transfer exception for a niece (when state and local regulations provide only for family transfer to parent or child).
