Report On Sewage System
In a short public session on Thursday, April 4, the Rappahannock Water and Sewer Authority heard reports on land acquisition and contractors’ progress.
The WSA’s attorney, Doug Baumgardner, said that all of the agreements with the property owners had been signed with the exception of three or four. “We have a title problem as far as one property is concerned, and as far as two properties are concerned we know what has to be done to line it up,” Baumgardner said.
The WSA members also heard a report on the contrators’ progress from Hank Gerhart, the engineer from Buchart-Hom, Inc. of Williamsburg. Work on the plant site has not begun even though one of the contractors did attempt to make a start.
“One contractor tried to go to work and could not get on the plant site because a car was parked in the way,” Gerhart said. “That has been resolved.” Gerhart said that he had not heard from the other contractor in a week.
The pipe contractor was to begin on April 1, and the plant contractor is to begin on April 15. Chairman Bob Dennis and Gerhart told the members that there should be no problems due to the delay as long as the work is begun soon.
The WSA then went into executive session to discuss legal matters.
• Breeden, Smoot Sentenced
Clate McKinley Breeden and David Lee Smoot were sentenced in Circuit Court on Wednesday, April 3 for various felonies and misdemeanors.
Breeden was charged with three counts of defacing property, two counts of breaking and entering, grand larceny and defacing State property. He was sentenced to five years in the penitentiary for each of the felony charges of breaking and entering and grand larceny and to 12 months in jail for each of the other four misdemeanor charges.
The five year sentences for the felonies are to run consecutively, and four years of each sentence was suspended. All four 12 month sentences were suspended. When Breeden is released, he will be on supervised probation for five years, and he will have to pay court costs within nine months of his release. He has already paid resitution.
Smoot was charged with three counts of defacing property, defacing State property, two counts of breaking and entering, two counts of grand larceny and petty larceny. He was sentenced to one year in the penitentiary for breaking and entering, five years for breaking and entering, five years for each grand larceny charge, 12 months for petty larceny, 12 months in jail for each defacing property charge and 12 months in jail for defacing State property.
All of the 21 year sentence was suspended except for five years in the penitentiary. Smoot will be on supervised probation for five years after his release, and he will have to pay court costs and restitution.
