Supervisor Charles Estes questioned the time limit of coverage of the policy. “If the claim is not filed until a later time — perhaps after the expiration of the policy — the new company won’t cover it because their policy wasn’t in force at the time. It’s a cut-out for the company . . . The liability is not carried forward after the expiration of the policy.”
“It’s a cheap shot. If we change carriers we leave ourselves wide open. Even with a one-year limit on retroactive claims, the statute of limitations is six years,” Supervisor Nelson Lane agreed.
“Are the mechanics available for the consultant to review the actual document?” Supervisor Newbill Miller inquired. “My constituents are going to ask, ‘You mean you signed this agreement and didn’t use the consultant?’
