“The county really has no say regarding a landfill,” noted the board’s legal advisor, Commonwealth’s Attorney Peter Luke. The only local permit involved came from the Board of Zoning Appeals, not from the Board of Supervisors, he added.
Mr. Forman wants a sign that the supervisors won’t try to continue the landfill on the Clark property “but I‘m not exactly sure what legal framework he’s working within,” Mr. Luke said. He advised the supervisors to simply assure Mr. Forman that they have no objections to extending the life of the current landfill to July 1. 1987.
