public facility, then such addition or expansion (or new construction) would be exempt from the ordinance requirements.”
In an interview Tuesday, Mr. McCarthy confirmed that adoption of the amendment will also mean “the county won’t have to get a special exception permit for a landfill” since provision of solid waste disposal is mandated by law.
As it now stands, the zoning ordinance allows a sanitary landfill in conservation, agricultural and industrial districts with a special exception permit granted by the Board of Supervisors and makes no distinction between public and private dumps.
Before approving a special exception, the board must determine that the proposed use satisfies certain general standards. Those standards include provisions that the use may not:
• Adversely affect the use, development or value of neighboring properties.
• Generate pedestrian and vehicular traffic that will be hazardous or conflict with existing neighborhood traffic.
• Degrade air quality.
• Degrade or unreasonably deplete surface and groundwater.
• Cause an undue impact on the historic or scenic qualities of the immediate area.
Following the public hearing, which attracted no speakers and lasted only a few minutes, the planning commissioners voted unanimously to recommend adoption of the exemption amendment as well as a clarification of uses allowed in various zoning districts after the columns in the list setting out those uses were jumbled in the printing of the ordinance. But they again tabled action on an amendment to add taxidermy as a special permit use and standards for taxidermy operations to the zoning ordinance, requesting more information on the chemicals used in this business and their proper disposal.
