Punitive damages are asked, and usually awarded, as punishment for the actions of the defendant. In civil cases which go to trial, damages are awarded only if the plaintiff is judged to prevail. Even if compensatory damages are awarded, punitive damages do not always follow, however. Usually, punitive damages are awarded where the judge or jury finds that the defendant acted with malice, with clear knowledge that his actions would harm the plaintiff, or with disregard for the consequences of those actions.
