feet in the back of the property. The amended request asked for a rezoning of 19,454 square feet. He said that they promised to erect an eightfoot privacy fence to screen the Nichols’ view of the lot within 120 days of receiving approval from the Board of Supervisors.
He submitted a site plan, the results of studies on wells that had been tested, and a statement on how the request fits in with the county’s comprehensive plan.
“The Settles would be glad to erect trees on the Nichols property if they would like it,” Mr. Fletcher said. “There is not enough room on the Settles’ land.”
Mr. Nichols reported that the test on his well had been good, but said the lab had not been able to test for petroleum products.
Board of Supervisors’ representative to the Planning Commission Mike Massie said, “In general I’d prefer to see commercial rezonings off the road rather than strung out along the road. It’s as good a rezoning as we’re going to get. They’ve downsized the amount they want to rezone. I move we approve it. ”
The motion passed unanimously with the provision that the privacy fence be perpetually maintained.
When the planners turned to the Lees’ request for a family apartment, attorney Douglas Baumgardner, speaking for the Lees said that it met all the conditions for a family apartment spelled out in the zoning ordinance.
He submitted several letters from neighbors supporting the application.
The Lees plan to build a twostory structure. The bottom floor will be an 800 square-foot garage, and the upper story will be an 800 square-foot apartment for Mr. Lee’s mother. The new building will be about 300 feet away from their present house.
Frank Reynolds, representing Beverly Amos, who owns land across the road from the Lees, said the permit would allow much more dense development than is planned for the area, which is zoned Agricultural.
He said that at a future date the garage could be converted making a 1,600 square foot house and the property divided making two separate lots.
