The planners voted to send the application to the Board of Zoning Appeals with a recommendation that it be approved on the condition that the building use the existing entrance and that there be no second road in the future. Dr. Krebser voted against the motion.
When the planners took up Mr. and Mrs. Johnson’s request for rezoning land across from their house on Route 671 near Sperryville, Mr. Johnson reported that he had been asked by the son of a neighbor to sell him one acre to build a house. He said he also wanted to deed land to his own son.
The planners tabled the rezoning request and suggested that Mr. Johnson clear up the question of the right-of-way and submit a plat that would leave a five-acre lot in the back of the property and designate four or five one-acre lots near the front of the property.

Mr. Reynolds said that the town could enact an ordinance prohibiting shooting within the town limits, but since the town has no police force and the Sheriffs Department is not authorized to enforce town ordinances, there would be no way to enforce such an ordinance.
The attorney’s memo also stated that it is against state law to discharge a firearm from a public street or within 100 yards of a public road. Mr. Reynolds suggested that there are very few places within the town that are more than 100 yards from a public street.
The Sheriffs Department or the game warden can be called on to enforce that state law in the town, Mr. Reynolds pointed out.
“If a citizen wants to file a complaint, there are laws to cover it,” member Stuart Willis noted.
“I guess we should file this with the helicopter ordinance,” member Louise vanDort suggested. “We need a special place for these things.”
