The other five persons were all convicted of contempt of court and fined.

Albert Gilbert Gray of Chester " Gap was fined $40, suspended on condition of good behavior for one year. Campbell Turner “Buster” Hitt of Woodville was fined $40 as was Linda Billings Kiser of Slate Mills.

Jackson N. Miller, Jr., who maintains a Washington address, and Jerry Lee Mills of Estes were each fined $50.

After dealing with the tardy jurors, Judge Brown heard a motion from Attorney John P. Morgan to set aside Walter’s conviction last month. After hearing Morgan’s argument and a rebuttal from Commonwealth’s Attorney Peter Luke, Judge Brown ruled the jury verdict would stand.

The jury had found Walters guilty of both grand larceny and breaking and entering, and had sentenced him to three years in prison on each count.

In other action the judge accepted an Alford Plea from Jimmy Wayne Nicholson of Woodville to charges of possessing cocaine and marijuana. Sentencing has been delayed until March 8, 1993 and Nicholson is free on bail.

An Alford Plea is an agreement by the defendent that the Commonwealth has enough evidence to gain a conviction, but in making this plea he does not offer any admission of guilt.
