“It would have the effect of eliminating the incentive of price competition among retailers,” said Jeff Trewhitt, spokesman for the Pharmaceutical Manufacturers Association. He said the Federal Trade Commission has ruled that it is legal for drug makers to sell the same drug at different prices to different buyers, in essence, offering quantity discounts and other incentives for volume purchases.
Despite Wood’s argument that the bill would mean lower drug prices for consumers, some committee members privately questioned why the bill was introduced in the first place. In addition, some committee members questioned why a pharmacist introduced a bill that would ultimately benefit himself and pharmacists across the state.
However, according to state law, the bill didn’t violate the state’s conflict of interest laws since the bill would benefit every pharmacy, not just Wood’s store.
Pointing out that lawyers who are members of the General Assembly submit legislation that benefits their industry. Wood suggested, “who else is better to know about the pharmacy industry” than a pharj macist. >
