Pursuant to a decree of the Circuit Court of Rappahannock County, Virginia, made and entered on the 1 st day of September, 1992, in the partition suit brought by Charles E. Yeager and others against Margaret Yeager Prudum ana others we will on Friday, the 19th of May, 1995, at the front door of the Court House in Washington, Virginia, at 11:00 o'clock a.m. on that day, offer for sale to the highest bidder. the following described real estate.
All that certain tract or parcel of land, containing 23.5028 acres, situate. lying and being in Stonewall Magisterial District. Rappahannock County, Virginia, and more particularly described, according to plat and survey of Smith - Hume & Assoc., dated March 27. 1990. AND BEING the same and identical tract or parcel of land conveyed to Lewis Roebuck and Abraham Wiggington by Silas Vaughan, by deed dated December 21,1874, and recorded in Deed Book O. at page 40.
Terms of sale: A bidder's deposit of $5,000.00, said deposit being due and payable on the date of sale in cash or equivalent funds with the balance of said purchase price being due and payable, in full, thirty (30) days from the date of sale. THE SALE IS SUBJECT TO THE APPROVAL OF AND CONFIRMATION BY THE CIRCUIT COURT OF RAPPAHANNOCK COUNTY, VIRGINIA. Settlement and compliance with the terms of sale to be had and complied with within thirty (30) days of the date of sale. In the event of default by the purchaser, the Court reserves the right to declare a forfeiture of the deposit, keep the deposit, and readvertise and re-sell the property at the risk and post of the defaulting purchaser.
