Berry had been on probation since 1992 when he pleaded guilty to grand larceny, for stealing a coffeewood tree. On April 3 of this year, he was convicted of stealing yet another coffeewood tree, which he said was dead and lying on the ground in Washington, D.C.
“This shows a lackadaisical attitude towards probation,” said Commonwealth’s Attorney Peter Luke.
Judge W. Shore Robertson found the conviction in Washington, D.C. to be a violation of his probation, and sentenced him to nine months in the jail and two additional years of supervised probation. Mr. Berry will, however, be allowed work release privileges while he is in jail.
