PUBLIC HEARING: AMENDMENTS TO THE ZONING CHAPTER AND TO THE EROSION & SEDIMENT CONTROL
CHAPTER OFTHE RAPPANHANNOCK COUNTY CODE
The Board of Supervisors of Rappahannock County shall hold a public hearing on the following proposed amendments to the Rappahannock County Code on Monday. January 5, 1998 at 7:00 p.m. at the Courthouse in Washington. VA.
These amendments, with the exception of the amendment to Chaptfer 98, were approved by the Rappahannock County Planning Commission at their regular meeting of December 19,1997.
The Erosion and Sediment Control Chapter amendment is as follows:
1. Amend §98-9F by deleting the at the end of the sentence and adding; “, except on property zoned “C”, Conservation, where the provisions of this article shall apply,”
The Zoning Chapter Amendments are as follows:
1. Amend §170-37 to alter the maximum allowable density in the Conservation Zone from one house per twenty-five (25) acres to one house per fifty (50) acres.
2. Eliminate the requirement in §170-22 B. (2) for slope calculations in the Conservation Zone by adding at end of section:
“Except that in the Conservation district, no such density calculation shall be made for excessive slopes; property in the Conservation district with steep slopes shall be calculated on a direct 1:1 basis’
3. Amend §170-38 by adding a new section H., to read as follows:
H. Single family residences in Conservation Zoning District
(1) . All single family residential construction in the Conservation Zoning District shall require an approved erosion and sedimentation control plan, in accordance with §98-6, et seq. of this Code.
(2) . All single family residential construction in the Conservation Zoning District shall be served by private roadways and driveways that equal or exceed the Type II standards as set forth in the Appendix to Chapter 147 of this Code, and shall be setback at least twenty-five (25) feet from neighboring property lines, unless:
A. The lot to be served was created prior to the adoption of this regulation and it is either impracticable or impossible to meet the standards; or
B. The driveway or access road is constructed to the Mountain Roadway Standard which shall consist of twelve foot wide gravel travelway surface with sufficient ditch, shoulder and culvert structures to ensure all-weather maintenance. Said road area shall be included in the area governed by the Erosion and Sedimentation Control Plan, but shall not be included in the calculation of 4, below; or,
C. An existing driveway or access road currently serving the property was created prior to the adoption of this section and was not created in an effort to circumvent these regulations; or,
(3) . Where alternatives exist, sewage disposal systems involving gravity fed drainfield systems shall not be placed on slopes exceeding twenty-five percent (25%). Alternative sewage disposal systems which are approved by the Virginia Department of Health and which require the removal of lesser amounts of vegetative cover, particularly arboreal material, are encouraged.
