and Council members Reinhardt Lynch and Claudia Mitchell and Treasurer Jerry Goebel voted for the appointment of Mr. Leggett.
After the voting Mr. Bennett informed the Council that he would have to petition to Court to make a selection, and that he was required to do so after the forty-five day appointment period had expired (Oct. 25).
The Council did not appear to take exception of this prospect until Mr. Weinberg spoke during the Public Forum at the end of the Council meeting. Mr. Weinberg said that he was “appalled that the Council would abdicate its responsibility for electing a candidate,” and suggested that they reach a compromise or select a third candidate rather than let the Circuit Court judges—who are not Tbwn residents, he added— make the decision for the Tbwn.
The Council agreed with Mr. Weinberg, and scheduled a continuation of the meeting for Oct. 23 at which time they will attempt to reach an acceptable compromise. Should they fail at that time, or by Oct. 25, to appoint a replacement Council member then the Circuit Court will have to make the decision for them.
Other activities
• The Tbwn Council held a public hearing on the adjustment of the boundary between the recently acquired Avon Hall property and the Child Care and Learning Center (CCLC) property (the Washington School) and on the purchase for $12,127.62, of CCLC’s share oi a .91 acre parcel adjoining the Avon Hall property (the Tbwn had agreed to the purchase of Col. Lyle’s share of that parcel at their September meeting). There were no public comments on this issue, and the Council unanimously agreed to both the adjustment and the purchase.
