At issue is whether Mrs. Fournier as a teacher had a responsibility as a so-called “mandatory reporter” to report the allegations of sexual abuse when the foster child told her.
A mandatory reporter is a person required by law to report to the Department of Social Services any suspected child abuse or neglect that they have learned of in their professional capacity. These professionals include persons employed as teachers, although foster parents per se are not listed.
A person failing to report suspected child abuse or neglect “within 72 hours of his first suspicion” can be charged with a misdemeanor and fined up to $500 for the first incident and between $100 and $1,000 for any further incidents.
