Diamond argued that perhaps someone other than Smatlak could resppnd to PEC’s information requests. “Maybe John doesn’t have the information, but people at Dominion do have that information,” he said. “Utilities collect information about specific demand by customer class, by geography, by use. In fact, (Dominion) cited little tidbits from that information in all the (public workshops it hosted in November and December). They have that information. They just don’t want to share it.”

Smatlak again insisted the data wouldn’t be “readily available.”

His answer astounded Watkiss.

“If the state grants a franchise monopoly that says you have to meet your customer demands in this area where you are a monopoly, how on earth could the utility not have that information about the historic consumption patterns and the assumptions going forward?” the PEC lawyer said.”They couldn’t meet their legal obligation if they didn’t have that.”
