Conversely, Dr. James C. Dimitris, a forensic psychiatrist at Central State Hospital, testified that although Gregory was “suffering from anxiety and depression in connection with his intense marital difficulties... they were not raised to the point of a mental disease.”
Under cross-examination by Mr. Howard. Dr. Dimitris concluded Gregory was confronted with “a very distressing, embarrassing situation but there was a decision made at that time to punish the wrongdoer.”
Defense attorney Jeffrey B. Rice chose to center his closing arguments on Dana, calling her a "vindictive woman” who is “painted red in the town of Middleburg as a result of this. She is the only one who wants to see Ted Gregory put away.”
In fact, Mr. Rice declared, “the only thing Ted Gregory ever did wrong was to marry Monique.”
Mr. Howard, however, turned his argument to Gregory and his state of mind at the time of the shooting. He read to the jury an excerpt from the Shakespeare tragedy Othello which he said “was more appropriate to Ted Gregory than anything you’ve heard in these four days.” “...I pray you, in your letters, when you shall these unlucky'deeds relate, speak of me as I am. Nothing extenuate, nor set down aught in malice. Then must you speak of one that loved not wisely, but too well: of one not easily jealous, but, being wrought, perplexed in the extreme...”
