the sheriff?” Robert Eastham asked from the audience. “Can you order him to do this or that?”
The supervisors have no authority over any constitutional officers, Latham said. “If they’re not doing their job, we can file a complaint and take them to court.”
Smoot said he’d contacted the state police and had been told it was the sheriffs department’s duty to handle the problem.
Supervisor Hubert Gilkey asked if the board had passed a curfew ordinance in response to Smoot’s complaints in years past.
“A curfew doesn’t have anything to do with somebody pulling up in your yard...The problem is getting somebody up there to get them out,” interjected Supervisor H. B. Wood.
Eastham maintained that it’s the awful duty of the governing body to see that order is kept in the county.
“If it’s my duty, I’ll accept it but you tell me how I’m going to go about it,” Supervisor Chairman Latham responded.
“It seems to me you should have the authority,” said Eastham.
“Over whom? Over what?” Wood asked.
“If I go out and raise cain in front of Mr. Buntin’s house, somebody wbuld do something about it,” Smoot argued.
“It seems like the problem is getting the law to come to your house,” replied Wood.
“And in the meantime, Mr. Smoot, don’t go out pulling a gun on anybody!” Eastham cautioned.
