“We have responded every time we’ve had a call down there!” reported the sheriff, walking in on the board meeting in time to be asked by the supervisors if they had the authority to order the police to respond. Not only has the sheriffs department answered Smoot’s calls, Buntin added, he was at the scene within three minutes of receiving the latest complaint. According to the sheriff, he found about ten cars—all parked in front - of the Community Center— when he arrived at 12:15 and was told by the individuals that they were ready to leave in just a few minutes. On another occasion, Trooper Harry Newlin did find partyers on the premises at 1:30 a.m., told them to leave and then waited until the center was closed down, Buntin added.
“I’ve been up there 20 times or more,” the sheriff continued, reporting that he’d never found any vehicles on Smoot’s property or in his driveway.
Eastham asked the sheriff if he considered the Community Center to be a public nuisance.
“That’s questionable,” Buntin replied. He reminded the supervisors that at least five other houses are located as close to the Center as Smoot’s yet Smoot is the only person who has come to the board with complaints.
