Town council met in executive session Monday night with Baumgardner and Konick to discuss the pending litigation but reportedly took no formal action. Mayor Newbill Miller had left to take a trip Tuesday morning and was not available for comment. Baumgardner said “it would not be appropriate for me to comment on this priviledged information without authorization." As attorney for the town council, Baumgardner said he enjoyed lawyer/client relationship with the governing body and could not discuss the case without the mayor’s approval.
