One of the general clauses in a mortgage is called a “convenant against removal.” It states that the person who takes out the mortgage cannot demolish or remove any building without the consent of the holder of the mortgage. This clause is necessary because both land and buildings are included in the appraisal on which the loan is based. The demolish part sounds plausible, but what about the removal prohibition? A homeowner is not about to wrap up his house, put it in his station wagon and take off! Sure, homes can be moved, but that’s a major operation involving much time and effort. No one would try something like that. Or WOULD they?
