The county’s supervisors “put us in this bind by their negligence,” maintained Col. White. “I don’t see the reason for any of us risking our personal assets.”
“Did they put you in this bind knowingly, or did they in good faith negotiate (for coverage) only to be told no by the insurance company?” asked engineer Hank Gerhart.
“The board was acting under the assumption that the Water and Sewer Authority WAS included in its public officials’ liability policy,” Mr. McCarthy confirmed.
“They only learned after the fact that this was not the case.”
Carson Johnson proposed that the WSA first ask the supervisors for an indemnity resolution. “If that’s not forthcoming, then maybe we can come back at another date and make it a little stronger.”
In a series of votes, the WSA:
• Rrequested the supervisors to indemnify and hold harmless the Authority members against personal liability and the cost of defense until government officials’ liability coverage is obtained.
• Directed Mr. Baumgardner to review the general liability insurance policy now in effect and advise the members as to the scope of their powers under state enabling legislation.
• Ordered warning lights at Sperryville’s sewage treatment plant turned on again at night and the gate to the facility locked whenever the ODerator is ahspnf
