TITLE EXAMINATIONS
A title search or title examination for land, involves looking at public records to determine if the person claiming to own the land actually does own it, and to further see if there are any defects in the title to the land, such as unpaid mortgages and other liens, easements or unpaid taxes.
In order to perform a title examination, the attorney first traces the “chain of title” from the current owner back a number of years, carefully examining each deed, will, or other title transfer document. He then “comes forward” with this chain of title, checking the indexes for the name of each owner to insure the property had not been sold to more than one person, that there are no unpaid mortgages or other liens against the land, that taxes have been paid, and there are no other situations which would affect the title.
If you buy land without having a title examination performed, you are taking a tremendous risk that the property has some sort of problem with the title.
