Ms. Bruce also requested an opinion as to whether the county would be subject to the requirements of such an ordinance, should the town enact it.
“Interpretations,” Mr. Haley replies, “. . . have held that a locality’s zoning regulations apply to facilities of other governmental bodies of equal or lesser authority ... I cannot comment authoritatively on the application of this principle to this situation; i.e. the town seeking to enforce the exercise of its police powers outside its territorial boundaries against the county exercising its sovereign powers within its own boundaries.
