Testimony supports allegations
Addressing the three conditions attached to the special use permit, James Swindler maintained that only the number restriction had been violated. Apple pickers, who work from June through November, are temporary, seasonal; pruning workers are seasonal, too, he said.
“I wish the seasonal condition had been worded more precisely? I’m having a terrible time determining if it’s been violated,” said Mr. Monahan. If the condition is viewed separate and apart from the testimony at the 1984 hearing when the permit was issued, then the seasonal condition hasn’t been violated, he contended. “But if you consider the testimony, it has.”
“I think it’s perfectly valid to look at the testimony,” argued Mrs. Luke. From the transcripts of that hearing, it’s clear that the migrant camp wasn’t to be used year round, she pointed out. Mr. Sharp himself had said that the housing was for apple pickers who would be working from August through November, Mrs. Luke noted. “I feel there’s been a violation of this condition.”
