William T. Wayland, of Rt. 1 Sperryville, was found guilty Tuesday in General District Court oi brandishing a firearm and assault as a result of an incident which occurred on March 10.
The charges were brought by Nathaniel Dodson, who alleged that Mr. Wayland threatened him and fired a gun over his head during an argument concerning the surveying of a right-of-way through Mr. Wayland’s property.
Mr. Dodson testified that Mr. Wayland arrived where he was standing, with two surveyors from James Butler Surveyors of Warrenton, in the entrance to the driveway, about one-half mile west of the Rediviva bridge on Rt. 211 between Washington and Sperryville.
“He came down,” Mr. Dodson said, “and we got to arguing. He went to his truck, got a gun and shot over our heads. He told me to ‘get the hell out of the road.’ That’s when I went to the Sheriffs Department.”
On cross-examination by Roger Inger, Mr. Wayland’s attorney, Mr. Dodson said that he did not have permission from Mr. Wayland, or from Robert Fox, to do the surveying. Mr. Fox, who is Mr. Wayland’s brother-in-law, also owns land through which the right-of-way passes.
“I didn’t think you had to have written permission to survey,” Mr. Dodson said.
The two surveyors, Edward Kinard and John Miller, corroborated Mr. Dodson’s testimony. Mr. Miller said that he assumed Mr. Butler had
