Rappahannock moved a few steps closer to becoming the bedand-breakfast capital of the Commonwealth as the Board of Zoning Appeals granted a special use permit for another country inn in Huntly.
But the BZA members restricted Hugo Perez to using just five of the bedrooms in the 12bedroom house for overnight, accomodations, reading the ordinance differently than did the planning commissioners who had recommended a permit for a sixroom B & B.
“If it’s got six rooms, it’s a hotel, regardless if it’s called a tourist home or anything else,” contended Peter Kramer. “Automatically, at six rooms, it becomes a hotel,” he said, citing the ordinance’s definition of hotel and motel: “A building or portion thereof or a group of buildings which provide sleeping accomodations in six or more separate units or rooms for transients on a daily, weekly or similar shortterm basis..
“If it qualifies as a hotel, there’s a problem with putting it in an agricultural district,” said Chairman Lee Bird.
“It’s not allowed at all there,” added John McCarthy, zoning administrator and assistant to the Board of Supervisors.
In recommending approval for six rooms, the planning commissioners and Mr. McCarthy had relied on the ordinance’s definition for tourist homes, boarding houses and bed-andbreakfasts which limits such operations to “sleeping accomodations for not more than 12 persons who are not members of the family operating the establishment.” They construed accomodations for 12 persons to be
