Mr. McCarthy said that in drafting the ordinance, he included language from the Secretary of the Interior’s standards for rehabilitation and for new construction in historic districts. These standards would be guidelines for the ARB and would not have the force of law, Mr. McCarthy said.
Mr. McCarthy also added language to provide for those cases when a request to demolish a building is denied by the ARB. If the owner could show that the property was not sellable without tearing a building down, the building could be demolished. The ordinance spells out procedures for attempting to market such a property. Mr. McCarthy said that language was added to make the ordinance comply with the certified local government program.
Planning Commision member Mitzi Young suggested that the ordinance specify Colonial Williamsburg colors for buildings in the historic district, but the planners decided to let the ARB decide if they wanted to do so.
