Mayor Morehouse called the tougher requirements for existing lots “a legislative taking. ... 1 want to know what your legislative basis is for an ordinance that’s more restrictive than the health department’s?” he asked.
Mr. Miller agreed. “I think it’s wrong to require additional standards other that Virginia health department standards on an existing lot.”
The council decided to give Town Attorney Frank Reynolds a month to draft new language that would except lots larger than a half-acre (out of concern that some of the town’s very small “lots of record” would be developed with a single drainfield). Mr. Reynolds was also instructed to add language that encourages but does not require a back-up drainfield even in the grandfathered lots.
In other action, the Historic District Ordinance was also discussed. Planning Commission chairman Louise van I)ort presented the revised draft, and the town plans to hold a public hearing on the document in March.
Vice Mayor Brad Fisher reported that 111 applicants are being considered for the town’s new parttime administrative assistant position. Mr. Fisher said he plans to start interviews in the coming weeks.
