County attorney, Peter Luke, addressed the board, recusing himself from counsel on the matter. Luke said that he felt there would be a possible conflict of interest since he had once served as president of the AVFD. Luke suggested the board consult with Washington attorney Douglas Baumgardner.
The board voted unanimously to seek Baumgardner’s counsel and discussion on this request would resume at the June 22 meeting.
Other requests
In other special exception requests made to the BZA, the board unanimously approved a family apartment to be built over a three-car garage for Alvin and Lori Dore in Amissville. “Everything is well within the required limits,” County Administrator, John McCarthy said of the Dore request.
Barbara Adolfi, a clinical social worker in Sperryville, brought a request before the BZA to have a residential property be used as a tourist home for weekend guests who would rent the three-bedroom facility.
The board discussed if the facility met with all the requirements, including at least four parking spaces, all lighting ordinances and a screen to shield the area from neighboring commercially zoned areas.
During the discussion, Estes questioned Adolfi about the use of office space in the facility that is currently being used for her business. As a result of the discussion, Adolfi was advised that
