doctor of violating the terms of that special permit by employing more than three people and said the building does not meet setback requirements for general commercial zoning.
County Administrator John McCarthy, who in November notified McCue that he was operating in violation of his permit, told the commissioners that the property does not meet the 75-foot setback required for a commercial zone, but since the structure is already there it is “grandfathered” and considered to be in good standing with its zoning.
“It is very typical to grandfather spmething if it already existed,” said Board of Zoning Appeals Commissioner Alex Sharp.
Piedmont District Commissioner Gary Settle noted that the general commercial area was created to foster business growth.
Hampton District Commissioner Alvin Henry, who represents the district where the physician’s office is located, added that other businesses, such as Rappahannock National Bank, have succeeded in the commercial area.
“This is where we wanted commercial activities to grow,” he said. “This is a success in planning you’re seeing here.”
Prior to motioning that the commission recommend the permit for approval, Henry pointed out the importance of having a doctor in a rural area like Rappahannock.

The Board of Supervisors will consider the rezoning request at its 7 p.m. meeting on Monday, and attorney and former county zoning administrator David Konick has sent a letter outlining Brown’s concerns to each member of the board.
